CONSUMER HEALTH DATA PRIVACY NOTICE

This Consumer Health Data Privacy Notice explains how we collect, use, disclose, and otherwise process “Consumer Health Data” in the event that we collect such data. This Consumer Health Data Privacy Notice applies when you (“User”) register for an account or otherwise access, visit, and/or use our Services offered by us. This Notice excludes services that have separate privacy policies that do not incorporate this Privacy Notice, such as Third-Party Services and Third-Party Links.
These supplemental disclosures contain additional information relevant to residents of Washington or residents in states with similar “consumer health data” laws. This content should be read in conjunction with the rest of our Privacy Notice.
In case of conflict between our Privacy Notice and these supplemental disclosures, the supplemental disclosures shall prevail, where applicable.
1 Collection of Consumer Health Data
Because Lyona is a health and wellness service, much of the data we collect may be considered Consumer Health Data. We collect Consumer Health Data directly from you, including information you provide when you sign up for or use Lyona, information provided during chat conversations, and inferences we make to better support you. For example, we may infer your BMI from your height and weight or recommend different meal plans based on your preferences.
We may collect the following categories of Consumer Health Data where you provide it to us:
Information about your health-related conditions, symptoms, status, diagnoses, medical interventions, surgeries, procedures, testing, or treatments;
Vital signs, bodily functions, symptoms, or health measurements that reveal your health status;
Information about your use or purchase of prescribed medication;
Biometric and genetic data;
Precise location information;
Information, including location or precise location information, that could identify your attempt to seek health care services or supplies; and
Other information that may be used to infer or derive Consumer Health Data.

2 Uses of Consumer Health Data Permitted Under Applicable Data Protection Laws
We use your Consumer Health Data for the following purposes:
Providing and Operating the Services: To provide, maintain, and facilitate the Services, including products and services offered in connection with your Lyona account, in accordance with our Terms of Service; and to create, manage, and administer your Lyona account;
Transactional & Payment Processing: To facilitate payments for products and services provided by Your Twin, LLC;
Communication and Support: To communicate with you, including responding to inquiries and sending information related to the Services;
Security, Fraud & Abuse Detection: To troubleshoot and debug, including identifying and resolving technical issues, repairing errors that impair functionality, and fixing software defects; and prevent, detect, and investigate fraud, abuse, and security incidents, violations of our Use of Services Policy from the Terms of Service, unlawful or criminal activity, and unauthorized access to or use of Consumer Health Data or Lyona systems and networks, and protect our rights and the rights of others;
Legal, Compliance & Risk Management: To comply with legal, regulatory, and risk-management obligations, including establishing, exercising, or defending legal claims;
Contract Enforcement: To enforce our Terms of Service, including our Use of Services Policy incorporated therein;
Contractually Agreed Uses: To fulfill any other purpose described in our agreements with you.
3 How We Disclose Consumer Health Data
With Service Providers and Business Partners. We may share Consumer Health Data with service providers that process information on our behalf to help us operate and deliver the Services (such as hosting, payment processing, customer support, and security). We do not disclose Consumer Health Data to service providers or other third parties except as strictly necessary to provide the Services you request, to comply with legal obligations, or to protect safety and security.
Compliance with Laws and Law Enforcement Requests. We may access, preserve, and disclose Personal Information, including Consumer Health Data, to the extent required by applicable law, regulations, or legal process, including lawful requests from law enforcement or other government authorities.
Safety, Rights of Others, and Enforcement of Our Rights and Terms. We may disclose Personal Information, including Consumer Health Data, when permitted or required by law, in connection with claims, disputes, or litigation, or when disclosure is reasonably necessary to protect the health or safety of you or others, prevent fraud or abuse, enforce our legal rights or contractual commitments, or protect the rights of others.
Business Transfers. Consumer Health Data will only be transferred in connection with a business transaction to the extent permitted by applicable consumer health data laws, and only for purposes consistent with providing the Services you request. Any recipient of Consumer Health Data will be required to continue to process such data in accordance with this Privacy Policy and applicable consumer health data laws.
Third-Party Websites and Services. The Services may include links to third-party websites or services for your convenience. These links do not result in the automatic sharing of your Consumer Health Data with those third parties through the Services. If you choose to leave the Services and visit a third-party website, any information you provide to that third party will be governed by the third party’s privacy practices. We are not responsible for the privacy practices of third-party websites.
SALE AND SHARING OF CONSUMER HEALTH DAT. We do not sell Consumer Health Data, as the term “sell” is defined under applicable U.S. privacy laws, including the California Privacy Rights Act. We also do not share Consumer Health Data for cross-context behavioral advertising.
4 Rights and Choices
Subject to applicable law, you have the right to request access to, correction of, or deletion of your Consumer Health Data.
You may be able to access or update certain Consumer Health Data through your account settings.
Due to the technical design of our Services, Consumer Health Data may be contained within your chat history and may not be capable of being selectively deleted on a record-by-record basis. As a result, if you request deletion of your Consumer Health Data, you will be required to delete your account in order to delete your chat history and associated Inputs and Outputs.
If you delete your account, we will delete your Consumer Health Data, including your chat history and any Inputs and Outputs, except to the extent retention is required or permitted by applicable law or necessary to protect security, prevent fraud, or comply with legal obligations.
