1 Introduction

Your Twin, LLC (“we," "us," or "our") offers Lyona mobile application and the Lyona website (together, the “Services” or “Lyona”). Lyona is a software application that provides digital coaching and health- and wellness-related information through a text- and voice/video-based chatbot.

This Privacy Notice explains how Your Twin, LLC collects, uses, discloses, and protects your personal information (“Personal Information”), which is information that is directly linked or can be linked to you. It applies to Personal Information that Your Twin, LLC processes when you access or use our Services, including the Lyona mobile application and website (collectively, the "Services").

By registering for an account, accessing, visiting, and/or using the Services, you agree to the terms of this Privacy Notice and our Terms and Conditions of Service (hyperlink). If you do not agree, you must discontinue use of the Services immediately.

2 When This Privacy Policy Applies

This Privacy Policy applies whenever you (“User”) register for an account or otherwise accessing, visiting, and/or using our Services. It does not apply to services that have separate privacy policies that do not incorporate this Privacy Notice, like Third-Party Services and Third-Party Links.

Third-Party Services. “Third-Party Services” means any third-party software, application programming interfaces (APIs), tools, data sources, artificial intelligence technologies and large language models, payment processors, products, websites, or other services that are relied upon by, integrated with, or made available through the Services.

Third-Party Services may require the transmission or processing of certain Inputs and Personal Information by third-party providers in accordance with their applicable terms, privacy policies, and data-processing practices and for purposes related to the provision and operation of such Third-Party Services.

Third-Party Links and External Resources. When you use links or references to websites, content, or resources operated by third parties (Third-Party Links”) within our Services, the privacy policies of these third parties apply to any Personal Information you provide or consent to share with them. Their privacy statements will govern how this data is processed. We are not responsible for the information practices of such third parties.

3 Information We Collect and How

The information we collect depends on how you interact with us (for example, through our website or mobile applications), the Services you use (you may use only the website, Lyona application or both) and the choices you make (such as the information you choose to provide in the chatbot).

We collect information about you from multiple sources and in several ways, including information you provide directly, information collected automatically, and information we infer or generate from other data.

Information You Provide To Us:

Account Information. When you create an account, we collect information such as your display name, email address, password, and time zone. We may also generate indirect identifiers associated with your account.

Payment Information. For paid subscriptions, we collect billing-related information such as your name, billing address, and payment details.

User Content and Files (Inputs and Outputs). When you use our Services, we may collect the information you provide into the Services via Inputs. Inputs represent content you choose to provide to the Services, including by submitting photos, videos, text, data, or other information. If your Inputs contain personal information or reference external content that information will be collected. We may also store chatbot responses (“Outputs”) to provide continuity, personalization, and context across sessions, such as remembering your preferences, goals, and prior interactions so you do not need to repeat information.

Demographic and health information. We may collect demographic or body-related information that you choose to provide through chatbot—such as age, gender, height, weight or similar details—to enable specific features of the Services. We may also collect wellness-related information provided by you, such as mental state, sleep habits, exercise activity, or food intake, to support personalized nutritional coaching. Feedback Information. We collect information you submit through surveys, reviews, interactive features, interviews, or beta testing related to your use of the Services.

Communication information: If you contact us directly, we collect your name, contact information and the content of the communications.

Sensitive Personal Information. Some of the information above may be classified as Sensitive Personal Information under applicable law. This may include account access credentials, demographic information, and wellness- or health-related information you voluntarily provide, as well as certain information we infer to better support you.

We may collect Sensitive Personal Information that you choose to share. Our chatbot processes and stores the content of your conversations, including any Sensitive Personal Information related to health that you voluntarily provide.

We use Sensitive Personal Information solely to provide personalized wellness and nutritional guidance, maintain continuity in your coaching experience, tailor the Services to your individual needs, and secure and operate the Services.

Please do not share information you do not wish to be collected or used as part of your interaction with the Services.

  • Not HIPAA-Regulated Services. Your Twin, LLC and Lyona are not a “covered entity” or “business associate” as those terms are defined under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”).

Information you provide through the Services, including health- or wellness-related information, is not considered protected health information (PHI) under HIPAA and is not subject to HIPAA’s privacy or security requirements.

While HIPAA does not apply, we take the privacy and security of your Personal Information, including Sensitive Personal Information, seriously and handle it in accordance with this Privacy Notice and applicable state privacy laws.

Please do not submit information through the Services that you would only feel comfortable sharing with a HIPAA-covered healthcare provider, unless you understand and agree that such information will not be protected by HIPAA when provided to us.

Information We Create or Generate

We may generate or infer new information from other data we collect from you to better understand your preferences or characteristics (“Inferences”). For example, we may infer your body mass index (BMI) based on the height and weight information you provide in order to deliver the Services.

Information We Collect Automatically

  • Device Information and Connection Specific Information. We might collect information such as but not limited to browser type, operating system, IP address, device identifiers, time zone, the date and time of access to provide and secure the Services.

  • Service Usage Information. We might collect information about how you use the Services, including access times, feature usage, and interactions within the chatbot (such as links you click), to improve the quality and functionality of the Services.

  • Log and Troubleshooting Information. We might collect log files and diagnostic information related to Service performance. If an error occurs, we may collect information about the error, the time it occurred, the feature being used, the state of the application, and any content or communications associated with the error.

4 How We Use Your Personal Information

In addition to the purposes for which we collect Personal Information described above, we may use each category of Personal Information for the following purposes:

  • Providing and Operating the Services: Provide, maintain, and facilitate the Services, including products and services offered in connection with your Lyona account, in accordance with our Terms and Conditions of Service (hyperlink); Create, manage, and administer your Lyona account;

  • Transactional & Payment Processing: Facilitate payments for products and services provided by Your Twin, LLC;

  • Communication and Support: Communicate with you, including responding to inquiries and sending information related to the Services;

  • Personalization & User Experience: Personalize the Services based on your preferences and interactions;

  • Security, Fraud & Abuse Detection: Troubleshoot and debug, including identifying and resolving technical issues, repairing errors that impair functionality, and fixing software defects; and prevent, detect, and investigate fraud, abuse, and security incidents, violations of our Use of Services Policy (hyperlink), unlawful or criminal activity, and unauthorized access to or use of Personal Information or Lyona systems and networks, and protect our rights and the rights of others;

  • Service Improvement & Development: Evaluate, improve, and develop the Services, including enhancing delivery, effectiveness, quality, security, and performance, and developing new features, products, or services. We do not train or fine-tune machine-learning models using Personal Information;

  • Legal, Compliance & Risk Management: Comply with legal, regulatory, and risk-management obligations, including establishing, exercising, or defending legal claims;

  • Contract Enforcement: Enforce our Terms and Conditions of Service, including our Use of Services Policy (hyperlink);

  • Contractually Agreed Uses: Fulfill any other purpose described in our agreements with you; and

  • Compatible and Contextual Uses: Carry out other purposes that are consistent with the context of the information collected, or as otherwise disclosed to you before your Personal Information is used.

5 Children’s privacy

Our Services are not intended for individuals under 18 years of age, and we do not knowingly collect Personal Information from individuals under 18. If you are under 18, please do not use the Services or provide any Personal Information to us.

If you believe that an individual under 18 has provided us with Personal Information, please contact us at legal@twin4ever.com. We will investigate the matter and, if appropriate, take steps to delete the Personal Information in accordance with applicable law.

6 How We Share and Disclose Personal Information

We may share or disclose your Personal Information in the following circumstances:

With Service Providers and Business Partners. We may share the categories of Personal Information described above with service providers and business partners that perform services on our behalf or help us provide the Services. These services may include website and data hosting, large language model providers, email communications, analytics, troubleshooting, translation, payment processing, and other services related to operating and delivering the Services.

Compliance with Laws and Law Enforcement Requests We may access, preserve, and disclose your Personal Information if we believe doing so is necessary or appropriate to comply with applicable law, regulations, or legal process, including lawful requests from law enforcement or other government authorities.

Safety, Rights of Others, to Enforce Our Rights and Our Terms. We may disclose Personal Information to third parties when permitted or required by law, including in connection with claims, disputes, or litigation, or when we determine that disclosure is reasonably necessary to protect the health or safety of you or others, prevent fraud or abuse, protect against credit risk, enforce our legal rights or contractual commitments, or protect the rights of others.

Business Transfers: In the future we may sell, buy, merge or partner with other companies or businesses. In such circumstances, your Personal Information may be transferred as part of the transaction, subject to applicable law.

Third-Party Websites and Services. The Services may include links to, websites, applications, or services operated by third parties. If you choose to interact with these third-party services, you are providing information directly to the third party and not to Your Twin, LLC, and your information will be subject to the third party’s privacy practices.

Third parties may collect Personal Information about you, including information about your activity on the Services, if you access their services through links provided via the Services. We encourage you to review the privacy policies and data practices of any third-party services you access. The existence of a link does not imply endorsement of the third party or its practices.

SALE AND SHARING OF PERSONAL INFORMATION. We do not sell Personal Information, as the term “sell” is defined under applicable U.S. privacy laws, including the California Privacy Rights Act. We also do not share Personal Information for cross-context behavioral advertising.

7 How long we keep your information and how we secure it

We retain your Personal Information for as long as reasonably necessary to fulfill the purposes described in this Privacy Notice.

When Personal Information is no longer required by us, we or our service providers on our behalf will perform the necessary procedures for destroying, deleting, erasing, or converting it into an anonymous form as permitted or required under applicable laws.

In the event you delete your account, we will delete your Personal Information, including your chat history and any Inputs and Outputs, unless retention is required or permitted by law, necessary for our legitimate business purposes. We will not delete any anonymized data.

We have implemented reasonable safeguards designed to protect your information from loss, unauthorized access, misuse, alteration or destruction.

8 Your Rights and Choices

Depending on where you live and the laws that apply in your place of residence, you may have certain rights regarding your Personal Information, as described below. These rights may be subject to limitations, exceptions, and verification requirements under applicable law. In some cases, we may decline or limit a request if we have a lawful basis for doing so.

How to Exercise Your Rights. You may exercise your privacy rights by using the privacy and account controls available through your account settings, which allow you to access, update, or delete certain Personal Information directly.

If you submit a request directly to us, you may contact us using the contact information provided in this Privacy Notice. We may need to verify your identity before processing your request and may request additional information for that purpose.

We will respond to your request within 60 days of receipt, unless a shorter response period is required by applicable law. Where permitted by law, we may extend this period if reasonably necessary, and we will notify you if an extension applies.

If applicable law provides you with the right to appeal a denied request, you may submit an appeal using the contact information provided in this Privacy Notice

We will not discriminate against you for exercising any of your privacy rights.

Summary of Potential Rights. Depending on your jurisdiction, your rights may include:

Right to Know: The right to request information about our collection and use of your Personal Information, including the categories of Personal Information we collect, the sources from which it is collected, the purposes for collection and use, and the categories of third parties to whom we disclose it.

Right to Access and Data Portability. The right to request access to, and in some cases a portable copy of, the Personal Information we maintain about you, subject to applicable law. Due to the technical design of our Services, we may not be able to provide a portable copy of historical chatbot conversations, including Inputs and Outputs. However, you may access and review your chat history through your account settings.

Right to Deletion. The right to request that we delete Personal Information we have collected from you, subject to legal exceptions. Due to the technical and operational design of our Services, we may not be able to selectively delete specific items of Personal Information contained within historical chatbot conversations, including Inputs and Outputs. If you choose to delete your account through your account settings, this will delete your chat history and associated Inputs and Outputs. However, you may be able to delete certain Personal Information through your account settings.

Right to Correction. The right to request that we correct inaccurate Personal Information we maintain about you, subject to applicable law. Due to the technical and operational design of our Services, we may not be able to retroactively modify or correct chatbot Outputs generated as part of prior interactions. You may also be unable to selectively correct specific items of Personal Information contained within historical chatbot conversations, including Inputs and Outputs. However, you may be able to update certain Personal Information through your account settings.

Right to Opt Out of Certain Processing. In certain jurisdictions, you may have the right to object to or opt out of certain types of processing, such as direct marketing or certain forms of profiling, where applicable. Your Twin, LLC does not sell or share your Personal Information for cross-context behavioral advertising. Because we do not sell or share Personal Information, we do not offer an opt-out of sale or sharing.

Automated decision-making. We do not engage in decision-making based solely on automated processing or profiling that produces legal effects concerning you or similarly significantly affects you (such as decisions that impact your legal rights, financial circumstances, or access to essential goods or services).

9 Changes to This Privacy Notice

We may update this Privacy Notice from time to time. Any changes will be effective when posted and according to the Effective Date located at the top of this document. If the changes are material, we will provide reasonable notice as required by applicable law by sending an email to the email address associated with your account at the time of notice, and/or by providing an in-app notification through the Services. Such notice will be provided within a reasonable period of time prior to the effective date of the changes, which, unless otherwise required by applicable law, will generally be no less than thirty (30) days.

Continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Privacy Notice. If you do not agree to the updated Privacy Notice, you must stop using the Services.
